2. Our Services

Bluey Email provides software-as-a-service (SaaS) tools that help users send marketing emails, manage campaigns, and verify or generate leads through integrations with trusted third-party tools. We may update, modify, or discontinue parts of the Service at our discretion.

You agree not to misuse the Service for:

• Sending spam or unsolicited messages
• Violating anti-spam laws (CAN-SPAM, GDPR, or India’s IT Rules)
• Uploading or distributing illegal, obscene, or infringing content
• Attempting to hack, disrupt, or reverse-engineer the platform

3. Account Registration and Security

To use certain features, you must create an account with accurate, current information. You are responsible for maintaining your login credentials and for all activities under your account. If you suspect unauthorized access, notify us immediately at support@blueyemail.com.

4. Subscription, Payment, and Billing

All paid plans are billed through Stripe or Razorpay, depending on your region. You authorize us to charge your chosen payment method for recurring payments, taxes, and applicable fees. Invoices are available through your account dashboard. Failure to make timely payments may result in suspension or termination of your account. Prices and features are subject to change with advance notice via email or dashboard notification.

5. Refunds

Refunds are governed by our Refund Policy, available atblueyemail.com/refund-policy. Please review that policy carefully before purchasing a subscription.

6. Data Protection and Privacy

We respect your privacy. All personal data is handled in accordance with ourPrivacy Policy. We comply with GDPR, CCPA, and India’s SPDI Rules (2011). We use secure HTTPS/TLS protocols, regional data hosting, and encryption to safeguard user data.

7. Acceptable Use and Compliance

You agree to use Bluey Email responsibly and in compliance with all applicable laws. You must not:

• Use our Service to send misleading, fraudulent, or deceptive content
• Infringe on the intellectual property of others
• Interfere with system integrity or security

Violation of these conditions may result in suspension or permanent termination of your account.

8. Third-Party Integrations

Our platform integrates with tools such as Google APIs, Microsoft APIs, Reoon, and Outscrapper. These integrations are optional and governed by their respective terms and privacy policies. We do not share your collected user data with these services beyond what is necessary for functionality.

9. Intellectual Property

All software, content, design, trademarks, and code within Bluey Email are owned or licensed by us. You may not copy, modify, distribute, or create derivative works without prior written consent.

You retain ownership of the data and content you upload to Bluey Email. However, by using the Service, you grant us a limited license to host and process your data solely to provide the Service.

10. Disclaimer of Warranties

Bluey Email is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

In no event shall Bluey Email, its founders, employees, or affiliates be liable for:

• Any indirect, incidental, consequential, or punitive damages
• Any loss of profits, data, or goodwill arising from your use of the Service

Our total liability shall not exceed the amount you paid for the Service in the preceding 3 months.

12. Termination

We reserve the right to suspend or terminate your account for violation of these Terms, failure to pay, or misuse of the Service. Upon termination, your access will be revoked, and your data may be deleted after 30 days unless legally required to retain it.

13. Force Majeure

We are not responsible for delays or failures caused by events beyond our control such as natural disasters, internet outages, strikes, or government restrictions.

14. Indemnification

You agree to indemnify and hold harmless Bluey Email, its team, and affiliates against any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India, specifically the jurisdiction of Bengaluru, Karnataka. All disputes shall be resolved in the courts located in Bengaluru. If you are an EU resident, you may also have rights under the GDPR to bring claims in your local jurisdiction.

16. Dispute Resolution and Arbitration

In case of any disputes, you agree to first attempt informal resolution by contacting legal@blueyemail.com. If unresolved within 30 days, the dispute will be settled by binding arbitration under the Arbitration and Conciliation Act, 1996.

17. Changes to the Terms

We may revise these Terms from time to time. The latest version will always be available on our website. Your continued use of Bluey Email after changes constitutes acceptance of the updated Terms.
